Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the services offered on the http://fiberfin.com and http://store.fiberfin.com websites operated by FiberFin, Inc. ("us", "we", "our").

The Terms and Conditions presented here apply to all purchases and sales of items offered, and your purchase means you have accepted our Terms and Conditions of Sale. We disclaim any other Terms and Conditions contained in any customer purchase order, order form or otherwise unless expressly agreed by us in writing.

Our “No Hassle” Guarantee

The suppliers and manufacturers that we represent are the very best in the business. The brands that we carry are ones that you, our customers, have asked for. As such, all of the products that we carry are of the highest quality.

In the case that you receive a product from us that does not perform as described in our catalog, please call us. We will happily and quickly exchange the product or refund your purchase, providing that it is returned within 30 days of shipment and in its original packaging. (Returns subject to Q.A. inspection.)

Pricing and Charges

Pricing

Prices and charges on this document or website are effective upon publication and are subject to change without notice. All prices quoted are in U.S. dollars. We reserve the right to pass on any surcharges or impose purchase restrictions or limits at any time. Prices and availability may vary at branch locations.

Charges

All orders are subject to applicable shipping, freight, taxes and processing charges. Shipping charges for ground service on all stocking orders are determined by using a flat rate table that is based on the combined weight of all items on the order. There may be additional charges for split shipments on out of stock items. In some cases, shipping charges may be less than FiberFin's actual cost to process and ship, in other cases, they may exceed it.

Carrier Surcharges

Carriers may impose surcharges, which may vary and change at the carrier's discretion. FiberFin will pass on the surcharge.

Ordering

To order, please use the official FiberFin part numbers (beginning with "FF-") and short descriptions of each item.

Account Information

At the time of ordering, please notify our sales representative of changes in addresses (mailing, billing, and shipping), phone and fax numbers, or contact personnel.

International Orders

To place an international order outside of FiberFin’s website, please contact us by phone at 1-630-553-6924 (during business hours: 8:00 AM to 5:00 PM Central Time), or by fax at 1-630-553-6924. Warranties are subject to our discretion outside of the United States. All international orders will be shipped in strict compliance with U.S. export control laws. See the following section "Export Controls" for more information.

Billing

Billing Options

FiberFin offers standard terms and conditions for account customers. These terms are 1% discount for payment in 10 days, net 30 days from the date of invoice. To open a line of credit, a list of credit references and bank information is required, and can be provided through email or fax. FiberFin does not offer any terms longer than net 30.

In addition to open accounts, cash and credit cards (Visa, MasterCard, and American Express) are accepted. New customers placing small orders are asked to pay using a credit card online.

Shipping and Delivery

Shipping

Shipments are F.O.B. Yorkville, Illinois, unless otherwise negotiated. We will typically prepay and add freight, but will ship collect on any standard carrier's account number if it is specified on the purchase order and approved by the FiberFin sales office.

Delivery

Deliveries are made Monday through Friday during daytime hours only. Most orders are shipped using United Parcel Service (UPS). We also use other carriers for different regions. Items that are drop shipped directly from manufacturers may take longer to be delivered, so items ordered together may not arrive in the same package or on the same day. Orders placed on Friday (at the local cut-off time of 2:00PM Central Time) and weekends or holidays will be shipped on the next regular business day.

Title and risk of loss pass onto the purchaser upon delivery to the common carrier, or upon customer pickup.

Damaged or Lost Shipments

If receiving a shipment through UPS, FedEx Ground, other package carriers, or prepaid truck shipments with FiberFin’s carrier, check your order immediately upon arrival. All damages must be noted on delivery receipt. All shortages and damages must be reported to FiberFin (either by phone at 1-630-553-6924 or email at sales@fiberfin.com) within seven (7) calendar days.

If receiving a truck shipment with your own carrier, check your order immediately upon arrival. All damages must be noted on delivery receipt. All damages and shortages must be reported to your carrier within seven (7) calendar days. All damaged containers and merchandise must be kept for your carrier to inspect. It is your responsibility to file a claim with your carrier at that time.

Warranties

General Merchandise Warranty

Except when otherwise stated, the only warranties applying to materials sold are those, if any, specifically provided by the manufacturer to be honored by the manufacturer. Items indicated to have a "Lifetime Warranty" are subject to manufacturer's warranty terms. As sellers, we make no warranties, expressed or implied, of performance, merchantability, workmanship, quality, durability, suitability, or non-infringement including those instances where changes, alterations, or modifications are made in materials at the request or instruction of the purchaser.

Our obligation is limited only to the repair or replacement of defective parts or, at our sole option, to refund the purchase price. This warranty is exclusive and in lieu of any and all other warranties, whether written or oral, expressed or implied, including, but not limited to, any implied warranties of merchantability or fitness for a particular purpose. In no event shall we be liable for any incidental, special, indirect, punitive, lost profits or consequential damages of any nature.

A full refund will be given for any defective item returned to us and received by us within 30 days of the date of shipment in its original packaging (subject to our Q.A. inspection).

Machinery Warranty

Motorized machinery purchased directly from FiberFin shall be free from defects in material and workmanship for a period of one (1) year from date of shipment for mechanical components, and ninety (90) days from date of shipment for electrical/electronic components. Parts found to be defective in material and workmanship by FiberFin during the warranty period shall be replaced or repaired at FiberFin's sole option. Any components on motorized machinery found by FiberFin to be modified, altered, misused, abused or neglected will void the FiberFin warranty.

This warranty is exclusive and in lieu of any and all other warranties whether written or oral, expressed or implied, including but not limited to any warranty of merchantability and any warranty of fitness for a particular purpose and any warranty of non-infringement. Parts not covered by this warranty are parts subject to normal wear or consumable parts such as (but not limited to) belts, filters, greases and lubricants, batteries, lamps, and blades. Warranties are subject to FiberFin's discretion outside of the U.S.

Responsibility

The value of a defective product or material is FiberFin’s only liability. All technical information has been supplied by the manufacturer and is listed only as a convenience. We do not warrant or represent that the merchandise complies with the provisions of any law, particularly the Walsh-Healey Public Contracts Act, and the Occupational Safety and Health Act of 1970, and the regulations promulgated there under, unless the manufacturer so warrants.

Errors

Although all information on this website has been carefully checked for accuracy, errors and omissions may still be found and are subject to correction. We regret any inconvenience these may cause for our customers, and appreciate it when we are notified of them.

Compliance with Laws

Some localities may have codes, regulations, and laws governing sales, installation, use, or construction of items for certain purposes. FiberFin does not guarantee compliance and assumes no responsibility for how items are used or installed. The customer assumes sole responsibility for compliance with all applicable codes, regulations, and laws. This includes, but is not limited to, CSA, FAA, DOT, NEC, UL, NOM, IATA, IMDG, CE, DIN, and ANSI codes, regulations, and laws concerning the use or installation of items.

Products for Medical Use

FiberFin’s plastic optical fiber and cables (including components thereof) for use in conjunction with medical devices or medical applications are designed specifically for external use, and are not intended for use inside a body. The customer assumes responsibility for reading labels and instructions carefully, and following all directions for proper use.

Material Safety Data Sheets (MSDS)

A material safety data sheet (MSDS) is a document required by the Occupational Safety and Health Administration (OSHA) that provides specific safety, health, and environmental safety information about a product deemed to be hazardous. This may be due to hazardous ingredients in the product, or because it requires specific procedures for safe handling or control.

Manufacturers and importers are required to produce these MSDS’s, and employers are required to have them available for their staff as per OSHA’s Hazard Communication Standard 29 CFR 1910.1200.

FiberFin provides material safety data sheets when required. A MSDS will be provided for a product when:

  • You order a product for the first time,
  • An updated MSDS is received from the manufacturer or importer, or
  • You request another MSDS.

Material safety data sheets can be requested through the following means:

  • FiberFin’s online product catalog at www.fiberfin.com,
  • Contacting the FiberFin sales office (Phone: 1-630-553-6924; Email: sales@fiberfin.com), 
  • As part of an order, or
  • By mail.

Returns and Repairs

Returns

Except when otherwise provided, no material will be accepted for return after 30 days from date of shipment. To return merchandise, a customer must call FiberFin at 1-630-553-6924 to receive a return merchandise authorization (RMA) number.

When returning merchandise, include a copy of the original invoice or packing slip. All merchandise must be returned in its original packaging. Any claims of discrepancies in shipments must be made within seven (7) days of receipt of merchandise. C.O.D. returns will not be accepted. Shipping charges for returned items must be prepaid. Altered or etched items may not be returned. When returning items, a re-stocking charge may apply.

Computer Software

Unopened software may be returned for credit. Opened software will be replaced only if it is defective.

Cut-to-Length Products / Custom Cables

Because of the specialized nature of many of our customers’ fiber optic applications, we offer custom cable assemblies to fit their needs that are cut to length per their specifications. We reserve the right to charge a service fee for difficult or multiple cuts per item. However, cut-to-length products are considered final sale, and may not be returned for credit.

Repairs

To begin the troubleshooting and repair process, please call our technical service department at 1-630-553-6924, extension 116. In the case that an item must be shipped to FiberFin for repair work, the customer will be notified when the repair is completed and ready to be returned. Items left with us after sixty (60) days of this notification will be disposed of.

Export Controls

FiberFin products and services, including user manuals and software, are subject to all U.S. export control laws, regulations, and administrative policies. Diversion contrary to U.S. law is prohibited. The purchaser understands that a license, written approval, or other authorization may be required from the Bureau of Industry and Security of the U.S. Department of Commerce, the Directorate of Defense Trade Controls of the U.S Department of State, or other U.S. government agencies prior to the export or re-export of these items from the United States. Information may be found on The Bureau of Industry and Security website.

The purchaser further understands that it is unlawful to export, re-export, transfer, or attempt to export, re-export, or transfer these items to individuals or entities on the List of Debarred Parties, Denied Persons List, Specially Designated Nationals List, Entity List, Unverified List, or Nonproliferation Sanctions List, as well as sales or transfers to embargoed countries. It is the purchaser’s responsibility to be aware of these lists, which may be accessed here.

Controlling Law and Venue

The laws of the state of Illinois will govern all transactions and any dispute arising from or relating to these Terms. The parties submit to the jurisdiction of the state of Illinois and federal courts for or in Yorkville, Kendall County, Illinois, and agree that any legal action or proceeding relating to these terms may be brought in those courts.
